Terms of Use

You must read the Terms of Use for eClass App (these "Terms of Use") as set out below carefully. These Terms of Use are to be read before using this eClass App (this "Application") operated by eClass Limited ("eClass"). By using this Application, you agree to be bound by these Terms of Use. In the circumstances that eClass amends these Terms of Use, the app will show an update reminder, and your use of this Application following any such amendments constitutes your agreement to be bound by these Terms of Use as amended.

1. Limitation of Liability

  • User will use this Application in accordance with the Terms of Use. eClass may make new applications features or functionality for this Application available from time to time the use of which may be contingent upon the Terms of Use to additional terms.
  • User must not attempt any unauthorized use of this Application. User will promptly notify eClass of any unauthorized use of or access to this Application of which it becomes aware.
  • Unless eClass specifically agrees in writing, user will not, and will use commercially reasonable efforts to make sure a third party does not: (a) sell, resell, lease or the functional equivalent, this Application to a third party; (b) attempt to reverse engineer this Application or any component; (c) attempt to create a substitute or similar service through use of, or access to, this Application; (d) use this Application for high risk activities; or (e) use this Application to store or transfer any customer data that is controlled for export under the Laws.

2. Suspension of Services

  • If eClass becomes aware of an End User's violation of the Terms of Use, then eClass may specifically request that Customer Suspend the applicable End User Account. The duration of any Suspension by eClass will be until the applicable End User has cured the breach which caused the Suspension.
  • Notwithstanding the foregoing, if there is an Emergency Security Issue, then eClass may automatically Suspend the offending use. Suspension will be to the minimum extent and of the minimum duration required to prevent or terminate the Emergency Security Issue.

3. Provision of Information

  • This Application may collect and record your notification identification number of your mobile device so as to provide you a notification of account activities.
  • To improve your experience with us, eClass may analyse how you interact with this Application. These data generated and collected are anonymous and aggregated, and contain no name or address information or any information that will enable anyone to contact you via telephone, email or any other means. Other data such as IP (internet protocol) address may be collected during the use of this Application, which will be collected, processed or handled in accordance with the Privacy Policy posted on this Application.

4. Intellectual Property Rights

  • The trademarks, logos, copyright and any intellectual property rights of this Application are owned by eClass. You are granted no right or license with respect to any of the aforesaid trademarks.
  • eClass may also display eClass Brand Features on this Application to indicate that this Application are provided by eClass. Neither party may display or use the other party’s brand features beyond what is allowed in this Terms of Use without eClass’s prior written consent.

5. Disclaimer of Warranties

  • eClass makes no representations about any content or information made accessible by or through this Application.
  • The content, information or otherwise contained in this Application is provided on an "as is" and "as available" basis.

6. Others

  • The information contained herein describes the current practice with respect to this Application. The information may change as eClass revises this Application by adding or removing features or using different service provider(s).

7. Governing Version

  • If there is any discrepancy between the English and the Chinese versions of these Terms of Use, the English version shall prevail.
